Starting Over Consignment Agreement

I, the undersigned (Consignor) wish to consign items with Starting Over Consignments.  I agree to leave the items for a period of sixty (60) days.

SOC has the right to mark down items at any time during the 60 day period as determined by SOC Staff.   On the 60th day this contract ends.   I understand after this 60 days if I want to pick up any unsold item from Starting Over Consignments I will contact Starting Over Consignments to make an appointment for pick up.  I understand if I fail to pick up the unsold items by the 67th day any unsold item will become property of Starting Over Consignments.

During the 60 days consignment period SOC reserves the right to have in store specials.  This can include your items at a discounted price.

NOTE: Starting Over Consignment will not be held responsible for any damages or loss by reason of fire, theft, water or any other conditions whatsoever.

NOTE: Starting Over Consignments reserves the right not to accept an item for consignment.

Any item(s) that does not meet the SOC Policies will be returned to the consignor or donated if not picked up within 7 days of notice that said items cannot be accepted.

Consignors will receive 40% of the final selling price of each item sold by Starting Over Consignments less any buyers fees.  Settlement checks will be mailed out the first or second week of each month.  You can come in anytime and use your settlement as a store credit!  I understand that it is my responsibility to check on my account.  Monies will not be payable until the item has been sold.  SOC will furnish each consignor with a statement itemizing all sales transactions during the preceding period.  No statement will be sent to Consignors with a balance of $5.00 and less.

Consignee shall have the exclusive right to determine the business operation and management of its premises.  Consignor shall have no liability or responsibility for the operation and management of Consignee’s business, employees or agents and or other causes of action resulting therefore, and Consignee agree to defend, indemnify and hold harmless Consignor the same.
